Government Gazette 24100 of 25 November 2002 set out the regulations
(a total of 50) that will come into effect on 12 March 2003.
Some fourteen categories of entry permit are covered in the regulations.
Matters of particular concern (cost and admin.) for Business relate
to the contents of Regulations 24, 28, and 30 that deal with Business,
Work and Corporate permits respectively. In addition to the work
and corporate permits being issued conditional to a payment of a
training levy, certain categories of activity will be subject to
"as.
Foreigners intending to set up a business in S.A. will be required
to secure a business permit. The permit application will have
to be accompanied by a certification by a Chartered Accountant
that will show that two, at least, of the following criteria are
met: -
an investment stake of R2.5million
a business track record showing entrepreneurial skill
contribute to the geographic spread of economic activity
employment of five S.A. citizens
having an export potential
involving technology transfer
A work permit may be issued provided no suitable candidate
for a specified position is available domestically. The employer
of any such foreigner issued with a work permit will be required
to pay (quarterly and in advance) a training fee amounting to
2% of that foreign employee's taxable remuneration. Provision
exists for the levy to be reduced/waived if the employer can demonstrate
that a training programme is in place that is designed to ultimately
reduce the reliance on foreign labour.
A corporate permit may be issued to cover situations where
large numbers of foreign immigrants are required by certain industries.
These permits will also be liable for the 2% levy, but may be
reduced/waived depending on the training programmes offered or
upon specific circumstances that might arise (mining, agriculture)
